Medical Records of Other Wrestlers Treated by Dr. Astin Seized

Reported By: Deidre Dukes

ATLANTA (FOX 5) – There were new details Wednesday in the investigation surrounding the Benoit murder-suicide case.  FOX 5 News has learned that federal investigators recently seized the medical records of several professional wrestlers who were being treated by Dr. Phil Astin, the doctor who was Chris Benoit's personal physician.

Sources close to the investigation confirmed that pro wrestlers, Oscar Gutierrez and Mark Jindrak, were in fact patients identified by their initials, M.J. and O.G., in the federal indictment.

The return warrant obtained by FOX 5 News showed that investigators seized the men's medical files when local and federal drug agents searched Dr. Phil Astin's Carrollton office on June 27.

Dr. Astin has been charged with seven counts of distributing excessive amounts of painkillers.  The federal indictment alleges the doctor over-prescribed prescription pain killers to Gutierrez and Jindrak.

Drug agents said that just because the medical records of Gutierrez and Jindrak were seized and part of the investigation, didn't mean that either of them were prescribed steroids or over-prescribed other drugs.

The nine page return warrant FOX 5 News obtained Wednesday detailed the physical evidence seized from Dr. Astin's office.

According to the document, federal agents also collected the medical files of pro wrestler Chris Benoit and his wife, Nancy, a computer, bank statements and other office documents.

Dr. Astin became the focus of a federal investigation after investigators said his patient, Chris Benoit, murdered his wife Nancy and their 7-year-old son before committing suicide in the family's Fayette County home last month.

Homicide detectives are still awaiting the complete results of the toxicology report in the murder-suicide investigation, as they try to determine why Benoit killed his family and took his own life.

Investigators said they have ruled the Benoit deaths as a murder-suicide, but with so many unanswered questions, they expected that the medical examiner's results would rule out anyone other than Chris Benoit as the murderer.  Investigators are looking at the way Nancy Benoit's ankles were bound and how the cable Chris Benoit used to hang himself was placed around his neck.

Additional names revealed in the Fox 5 report are Lex Luger, Buff Bagwell, and Bob Holly.   Sidebar Video
